In Spain it is possible to access cannabis through cannabis social clubs. In order to access cannabis individuals are required to comply with local laws. Cannabis regulations in Spain may seem complex because they are continuously evolving. As a result, it’s critical to keep on top of the latest regulations.

Is Cannabis Legal in Spain?

Although the Spanish government has decriminalized cannabis for personal use, you must be extremely careful when consuming it. Spain's cannabis market operates in a legal grey area where it is legal to access and consume cannabis as long as it is in private.

Let’s break the Spanish laws down into five  sections:

1. Consuming Cannabis

Smoking cannabis in public places is illegal in Spain. If you’re caught smoking cannabis on a beautiful Spanish beach or relaxing in a Madrid park, you could face a fine.

The Spanish police may consider it cannabis trafficking. However, smoking cannabis in private spaces is legal

2. Buying/Selling Cannabis

It’s currently illegal to sell cannabis in Spain. If you’re caught selling cannabis, you could face jail time, criminal offences, and a steep penalty.

Even if you’re caught walking around with cannabis in public areas, the authorities may argue that you’re trafficking cannabis. However, it’s legal to sell cannabis seed, hemp, and other paraphernalia in Spain.

3. Accessing Cannabis

In Spain, it is possible to access cannabis through cannabis social clubs. In order to access cannabis individuals are required to become members of these clubs.

Becoming a member involves paying membership dues, which then grants individuals the privilege to obtain cannabis from these designated establishments.

4. Growing Cannabis

It’s legal to grow cannabis on your private property in Spain. However, there are some important regulations to consider.

For example, it’s illegal to grow cannabis in public view, and there is a two-plant limit per household. It’s also illegal to sell the cannabis you grow for commercial purposes.

5. Medicinal Cannabis

On May 30, 2022, the Spanish Socialist Workers' Party (PSOE) introduced a bill to fully legalize medical cannabis nationwide. However, there have been continual delays, leading to uncertainty about whether medicinal cannabis will become fully legal.

The newly appointed health minister, Mr Miñones, said: “Unfortunately… the information is insufficient, and we cannot recommend its use. We must go hand in hand with scientific evidence to balance benefits and risks. We continue to work on it.’

Currently, you’ll have to grow medicinal cannabis at home or visit a cannabis club to consume it.

Cannabis Clubs in Spain

It is legal to consume cannabis in Spanish cannabis clubs if you meet specific criteria. In Spain, you will need to become a member of a cannabis club before you can access their facilities

However, although there are numerous cannabis clubs in Spain, you won’t find their information widely available. That’s because the law of private consumption prevents cannabis clubs from publicly advertising, making it not widely available in search engines.

Fortunately, Toke embraces different countries' regulations and works with these laws to ensure that information is available to the right people. For instance, only members are able to see a club's menu.

Finding Cannabis Clubs in Spain

The best way to find information on clubs in Spain is to use Toke's dispensary search where you can find locations, hours, and even membership forms or menus if you are an existing member. Alternatively, you can ask locals about the best spots.

If you’re considering visiting one of Spain’s cannabis clubs or coffee shops, you must ensure the club is a private space. Private venues are often called cannabis clubs, coffee shops, or cultural associations. Spanish authorities consider these clubs “legal spaces for consumption” if they’re not making a profit.

How to Join a Cannabis Club in Spain

There are only a few ways to join a cannabis club in Spain, but it’s entirely possible if you’re willing to follow a specific procedure. Nonetheless, you may encounter these restrictions in Spain:

  • Restricted to Spanish citizens only: Many clubs in Spain are limited to Spanish citizens only.
  • An age limit of 21: In most cases, there is an age limit of 21 to enter the cannabis club.
  • Referrals: Some clubs in Spain are only available if a current member has referred you.

The most common barrier to joining a private cannabis club in Spain is the referral system. You can use some online registrations as your reference, but you’ll still need to meet the basic legal requirements.

During the sign-up phase, you’ll need to provide government-issued identification, such as a passport, driver's license, etc.

Secondly, you’ll need to provide a residential address in Spain. A cannabis club will not accept a hotel or hostel address. You’ll also need to pay a membership fee; in most cases, the membership fee costs between 15 to 50 Euros.

Remember, even if you purchase cannabis inside the coffee shop and you’re a paid member, you can’t take it outside the door.

Final Thoughts

Although cannabis laws can seem tricky in Spain, you can legally consume it if you follow the government’s guidelines. That said, remember these two fundamental legal guidelines above anything else:

  • You can only consume cannabis in private spaces.
  • You’re never allowed to use cannabis publicly.

All in all, the best way to consume cannabis in Spain is to join a private cannabis club or grow and consume it from your home address away from public view.
